Generative AI training data and outputs: privacy and copyright checklist
A source-to-output review for personal data, lawful basis, web scraping, rights reservations, training records, human authorship, and third-party claims.
Overview
A source-to-output review for personal data, lawful basis, web scraping, rights reservations, training records, human authorship, and third-party claims.
What to review
- Create a source register for licensed, public, customer, synthetic, employee, and scraped data, including provenance, collection terms, purpose, jurisdiction, retention, and permitted uses.
- For personal data, identify controller/processor roles and legal basis; assess necessity, reasonable expectations, rights, transparency, security, retention, DPIA, and cross-border transfers.
- Do not assume a model is anonymous: the EDPB calls for case-by-case assessment of identification and extraction risk and supporting technical evidence.
- Record copyright ownership, licences, text-and-data-mining rights reservations, exclusions, takedown processes, and the EU GPAI copyright policy and training-summary duties where applicable.
- For outputs, preserve prompts, source material, human selection, arrangement, editing, and approval; the U.S. Copyright Office emphasizes sufficient human authorship rather than prompts alone.
- Test memorization, leakage, similarity, attribution, replicas, and harmful output; create escalation, deletion, retraining, filtering, claim, and incident procedures.
What to do next
Privacy, copyright, contract, publicity, confidentiality, consumer, and sector rules can overlap without producing the same answer. Review both development and deployment: unlawfully processed training data may affect later use, while ownership of an output does not itself resolve infringement risk.
